Title: Dr Monegal's masterwork
Post by: notatroll on May 27, 2018, 02:10:52 PM
I have the links to some pictures of Monegal's 'masterwork'. It's really the worst cosmetic case I've ever seen. Worst case ever. Fractures, bad fixation, strong misalignment, terrible wounds (butcher). This is unacceptable in cosmetic surgery. This so called surgeon should be sued by the patients. Their legs are totally destroyed and they were a healthy person before. Other patients have had problems but you won't see anything like this. I'm not sure if it's legal to post the link and I don't want to make the patient suffer, so send me a PM if you want to see.

Why would it not be legal to post but legal to PM?

To hold someone liable the disclosure of facts must be public. PM are... private.

In this case I think it's legal to post.

A plaintiff must establish four elements to hold someone liable for publication of private facts:

1. Public Disclosure: The disclosure of facts must be public.
2. Private Fact: The fact or facts disclosed must be private, and not generally known.
3. Offensive to a Reasonable Person: Publication of the private facts in question must be offensive to a reasonable person of ordinary sensibilities.
4. Not Newsworthy: The facts disclosed must not be newsworthy. Stated differently, the facts disclosed must not be a matter of legitimate public concern.

This is a matter of legitimate public concern and it doesn't offend anyone (perhaps the surgeon who did the botched job?). But I prefer to stay safe.

If they shared that material I think you can post... Or did you hack those patients' devices? ;D
